Great economic dependency generated by the use of fossil fuels has made that national and international administrations are adopting new economic and regulatory instruments with the intention of increasing the share of renewable energies in final energy consumption, so that economic efficiency and environmental sustainability are improved. On 25 May 2007 published the RD 661/2007, which regulates the production of electrical energy in special regime, ratifying the strategic commitment in favour of the development of renewable energy and in particular of photovoltaic solar energy, which began with the RD 2818/1998 and which was consolidated with the RD 436/2004, providing a legal continuity for the sector. From 2007 until actually, successive changes in the regulations have been produced in regards to technical and administrative requirements for the inclusion of an installation in the special regime and the economic conditions. The continuous regulatory changes have meant a major distortion in the evolution of the energy mix. In particular, we will analyze how the evolution of the legislation has affected installations of photovoltaic solar energy and what should be actions of the legislator that provide the regulatory stability required by this type of facilities.
