Consideraciones sobre la nueva Ley de contratos del sector público en la gestión de proyectos de desarrollo SW

Abstract

In this work, we have analysed the aspects of the new Spanish regulations on public procurement that mainly affect the management of public SW development projects. Very recently, in 2018, Law 9/2017, dated November 8, on Public Procurement came into effect in Spain. This Law enhances the principles of Good Governance which must be transferred to the management of public projects, not only fulfilling the principles of accountability, transparency and efficiency but also taking into account social and market repercussions. Accordingly, we have analysed the aspects that should be considered in the management of public SW development projects, especially in those projects that used agile approaches, from the definition of a project until its completion. Among the aspects on which we focus most in this work are those relating to eligibility criteria that must be included in the specifications of technical and administrative clauses, the considerations for monitoring and compliance in the execution of the projects following the principles of this new Law.
