Spain and Italy, as member countries of the European Union, have as a common regulatory framework on public procurement of construction works, the European Directive 2014/24 / EU of February 26 on public procurement, but the different cultural and organizational characteristics of each country make that the minimum requirements set out in the Directive are transposed into national law in different ways or are broadened with different aspects of the national procedures.
The objective of this communication is to carry out a comparative analysis of the Spanish public procurement regulation (Law 9/2017, on Contracts of the Public Sector) and the Italian regulation (Legislative Decree 50/2016, Code of public contracts), studying the most important items (types of contract, justification of technical and economic solvency, formulae to assess the criteria, formulae to assess the disproportionality, etc.) in the public procurement of works and in the public procurement of engineering and architecture services.
