Until recently, the industrial heritage was unprotected in Spain and its main assets in a state of neglect. In 1985 was published the Law 16/1985 on Spanish Historical Heritage which, although not directly considered industrial heritage, implicitly referring to it. Besides this law serves as the basis for subsequent National Industrial Heritage Plan (Plan Nacional de Patrimonio Industrial, 2001), whose specific mission is the study of Spanish industrial heritage to catalog, conserve and regulate actions and intervention projects cataloged assets.
Moreover, given that Article 148 of the Spanish Constitution provides that the Autonomous Regions may assume jurisdiction over the monumental heritage, all regions have developed their own laws in this area, which includes the industrial heritage. Such are the regional provisions of Andalucía and Asturias which expressly mentions the industrial heritage. However, in the case of the regions of La Rioja and Castilla-La Mancha, their heritage laws hardly refer to the industrial heritage.
In this paper is analyzed the regulatory framework of industrial heritage in these two autonomous regions and are considered the main existing industrial heritage assets in them.
