PROBLEMÁTICA SUSCITADA CON LOS PROYECTOS BASADOS EN PRESTACIONES EN MATERIA DE SEGURIDAD CONTRA INCENDIOS EN LAS TRAMITACIÓN DE LICENCIAS MUNICIPALES

Abstract

Since the approval of the Spanish Building Code, Spanish legislation enables the design of buildings with a performance based approach to fire safety. This Code sets the objectives explicitly and defines how to reach them without a compulsory procedure or solution to achieve them. The high potential of this performance based design is in practice limited because the lack of other legislation developing this complex subject. This situation has driven the municipal authorities into a difficult situation, particularly with highly complex projects, in which they have to accept responsibility far beyond than with traditional prescriptive projects. The lack of technical and procedural national regulation to develop and supervise these performance based projects is the main difficulty in supervising, and obtaining their municipal licenses.
